Sociair SMS shall provide SMS Gateway service (Value Added Service Provider (VASP)) of the major Telecom Operators of Nepal: Nepal Telecom (NTC)and Ncell.

1. We request our users to remain within the legal boundaries of the Government of Nepal, Nepal Telecommunication Authority and Telecom Network Operators by following their norms and regulations.

2. Spamming and unsolicited messages can be subject to a penalty of  NRS. 10,00,000 per instance as imposed by Telecom. On a requirement basis and as per discretion of the Telecom Operator, the Operator may ask for a copy of the subscriber consent letter from VAS Provider at any time.

3. Multiple tests to bypass any profanity filtered(Restricted) words results in system suspension of the account immediately and in extreme cases also liable to a fine of Rs. 1,00,000.

4. Sociair SMS strictly abides by the Election Code of Conduct set by Nepal Election Commission. Their guidelines states“ No votes shall be solicited and election campaign shall be conducted through social network with the use of electronic means such as S.M.S., facebook , viber etc”. If found otherwise, client would be solely responsible for the act and their account terminated until further notice. 

: Any violation of the rules regarding Election Code of Conduct shall result in suspension of the account immediately until further notice is provided to the user. 

1. Clients are liable for their message content and make sure that they don't contain any information which is strictly confidential or prohibited by the law. If found otherwise, religion or person will be fined at least 1,00,000 along with legal action as per government law.

2. The clients are unauthorized to render SMS service to any international clients for sending SMS to Nepali numbers during API integration. If such a case is found, the operator shall have the right to fine NRS. 10,000,000 and VAS provider immediately terminate the Agreement.

3.We serve only to companies registered in Nepal, any use of this service for other companies outside Nepal shall be treated as mentioned in clause number 2 above. 

Both the parties shall not disclose any confidential information received during any period of the agreement without prior notice to another party, but not limited to, information as appropriate for compliance with applicable laws of the land, enforcement of relevant policies, or protection of customers or others rights, property or safety.

Upon termination or expiration of the Agreement between User and Sociair SMS, each party’s rights to use or possess Confidential Information automatically terminate immediately. Each party shall return, or at the other party’s request provide verification of destruction of, any copy of any other party’s Confidential Information it may possess.
